1. General Terms of Sale
By purchasing from David Norden African Art, whether through direct sale or auction, you agree to the following terms.
Payments are processed securely via Ingenico, PayPal, or wire transfer.
Your card or account will be charged when you click the “Buy” button, and we aim to ship your order within three working days with a tracking number.
We cannot be held responsible for damage or loss once the parcel has been handed to the carrier, but we will assist you as best as possible should any issue occur.
2. Authenticity and Guarantee
All artworks are legally acquired, authenticated, and described to the best of our knowledge.
Each piece comes with written documentation confirming our opinion and appraisal.
We offer a two-year legal guarantee on all online purchases, provided the item is returned in its original, unaltered condition.
If our description proves inaccurate, you may exchange the item for another of equal value within two years of purchase, after consultation.
3. Refunds and Returns
Our refund and returns policy lasts 30 days from the date of delivery.
To qualify, the item must be in the same condition as received, including any provided documentation or stand, and must be accompanied by proof of purchase.
Partial refunds may be granted if:
- Documentation or accessories are missing,
- The object has been altered or damaged after purchase (not due to our error),
- The item is returned after 30 days, but our description is proven inaccurate.
Once your return is received and inspected, we will confirm receipt and inform you whether your refund is approved.
Approved refunds are issued to your original payment method or as credit toward a future purchase.
Sale items are also eligible for refund or exchange.
4. Exchanges
Exchanges are accepted only for items that are defective, damaged, or inaccurately described.

5. Shipping and Returns
Return shipping costs are the buyer’s responsibility and are non-refundable.
Outbound shipping and return costs will be deducted from any refund.
We strongly recommend using a trackable and insured shipping service, as we cannot guarantee receipt of untracked parcels.
Shipping rates:
- Free within Belgium
- €40 within Europe
- €80 to the USA
- €100 to the rest of the world
Customs duties or taxes are the buyer’s responsibility. We will not falsify customs values.
6. Auctions and Buyer’s Premium
At auction, all lots are sold to the highest bidder. A 22% Buyer’s Premium is added to the hammer price.
Lots are shipped only after full payment has been received.
Payments: accepted in euros via wire transfer, credit card, or PayPal.
VAT: included under the Margin Scheme (non-deductible).
7. Disputes, Returns, and Refunds for Auction Purchases
If there is an authenticity dispute or descriptive error, written notice must be sent within one month of receipt (as confirmed by tracking data).
You may be asked to provide a written statement from a recognized expert.
If the claim is validated, a refund or exchange will be arranged once the item is returned in its original condition.
After 30 days, returns are only accepted for credit or consignment resale, at our discretion.
Buyer’s premiums and original shipping charges are non-refundable.
Fragile objects are shipped entirely at the buyer’s risk.
8. Storage, Payment, and Delays
We can hold fully paid items for up to 90 days free of charge.
After that, a 2% storage fee (of invoice total) applies for six months.
After one year of non-collection, ownership reverts to David Norden Gallery.
If payment is not received, the lot may be resold, and the buyer remains liable for any losses and collection costs.
9. Jurisdiction
All transactions are governed by Belgian law.
Any disputes shall be settled in Antwerp, either through arbitration or judicial proceedings.
10. Privacy Policy
Data Collection
When you make a purchase or sign up for our newsletter, we collect personal data such as your name, email, billing and shipping address, and payment information solely to process your order and communicate with you.
We do not sell, rent, or share your information with third parties except when required to fulfill your order (for example, providing your address to shipping services).
Payments
Online payments are processed through Stripe, PayPal, or secure wire transfer.
Your payment data is encrypted and never stored on our servers.
Cookies
Our website uses cookies to enhance your browsing experience, track anonymized statistics, and improve functionality.

Email and Marketing
If you subscribe to our newsletter, your email is stored securely via Flodesk, our email provider.
